No, a new kernel can work with older tools - the code may be under 
COMPAT_40 in current though. An ioctl changed, but compat code for
the old ioctl is there.

that's true (only for xentools3-hvm, non-hvm are still working fine).
A recent kernel and userland from HEAD or netbsd-4 is required to
build working xentools3-hvm.
