Indeed this is a special case, and my impression from the silence is
that those who know, don't talk.

I've seen mention of 'not for bulk', and generally had the impression
that this concept is buggy, as bulk builds should not be special -- but
maybe I'm missing something.  However, this one being coded to be skipped
quietly seems appropriate, since official bulk builds, by doctrine, are
supposed to not have any custom settings.

Did you get a lawyer to say the DMCA would be interpereted that way?
But seriously, it's not about security; it's about a prohibition on
circmuventing technical means to protect a copyrighted work, or
something like that.
