 in dksubr.c in dk_open() we have:
 
         if (dk->dk_nwedges != 0 && part != RAW_PART) {
                 ret = EBUSY;
                 goto done;
         }
 
 What part of those conditions are true, triggering the EBUSY
 for /dev/dk1 ?
