Indeed.  I think this is why we have the distinction between

sys/XXXXio.h (or sys/XXXX.h), which defines structures and interfaces  
between kernel/userland

and

dev/XXXXvar.h which is used internally by a driver.

It seems to me that headers shared between userland and the kernel are  
candidates for sys/sys.
