I've asked Darren about this issue.
And he said he can't see why it would be necessary to remove the patch 
from your FTP server.

So, how about mail (privately) to Darren about the patch and its URL,
and ask "if you have any problem to redistribute this, please tell me"?

Yes, I still don't understand how the above his statement is
consistent with ipfilter license, but that is what ipf's author said. ;-)

Perhaps NetBSD is always getting his approval about modification?
I don't know actually...
