Subject: myrinet license compatable with NetBSD kernel?

I would like to encourage a driver for Myrinet hardware in the NetBSD
kernel.  There already exists code that could be used as a starting
point.  However, it is licensed as follows:

Is this compatible with the NetBSD kernel?  That is, if this code
magically worked and was technically acceptable, would the license be
an impediment to integrating the code into the kernel?  By the way,
who actually decides such issues?
