Yes, probably. I didn't realize I can't adjust sample rate
on the chip.
I found it apparently working for my hw (rev. H), so I did the
least thing to make it attach (and to my knowledge, working).

If the driver kind of works (with exception of unsettable sample
rate) even when codec doesn't support variable rate audio, probably
the message "codec must support AC'97 2.0 Variable Rate Audio"
should be changed to warning only and the code should attach the
device anyway in all cases.

The warning would be something like:
"%s: codec does not support AC'97 2.0 Variable Rate Audio, no hardware sample rating available"
