At some point between 1.4 and 1.5, the syslogd pid file changed from
syslog.pid to syslogd.pid, as did the default pid file configured into
newsyslog.  If you've got a new syslogd and an old newsyslog, or vice
versa, it could cause this, or maybe even if you've just got an old rc
that starts syslog using the old pid file name...
