as was noted in the followup to the PR, this is fixed by
rev. 1.231 of vfs_subr.c. this change did introduce a different bug
which was later fixed by rev 1.83 spec_vnops.c.
both fixes are in 3.0 and I've requested them both be applied to 2.x.
