First off the govenment does not have a stake.  Copyright is a legal 
standard based in public law.  It is however up to the owner of the 
copyright to defend it and if they choose not to in writing then they 
loose their protections. DIGITAL and their heirs legally own ultrix 
until such time as they freely release it the copyright holds.

Now, if they do defend it it could be very costly to defend against and 
even more so if the defendant looses.
