IANAL and I'm not among the people responsible for handling NetBSD's 
copyrights and other intellectual property (talk to board@ for that),
but my gut feeling would be that files with no explicit copyright notice 
are under the NetBSD copyright, and that you shouldn't have any problems 
doing with them whatever the NetBSD copyright allows you to do.
