It looks like I was wrong, ether_input apparently assumes that tags are
not stripped if no VLAN is enabled and the bug is in the ioctl method of
the gsip driver, which does not update the hardwar state if interface
state changes. Other symptoms are: PR 32900 (VLAN-sized packets are
dropped) and nonworking hw checksumming (confirmed on 3.0).
