I have seen it on every machine I put the TBSC in, even with 3.99.1x. That
was with a GENERIC kernel.

You can make it happen by reinitializing the card many times. I suggest you
put a full reinit when the device is opened to speed up things (yeah,
rebooting untils it fails can take some time).
