 3.99.7 is still having that problem.
 ATA drive caches where off, system paniced due to other reasons during a
 run of cvs update.
 
 -> zero sized files (could be cvs) BUT also RCS file with binary 0 (= 
 '\0', NUL, ...) in
 them - softdeps? / fsck?
