Correct.  MKMAN should only ever be set to "no" in user configuration.
MKMAN=yes in mk.conf is incorrect.

However, the Makefile in question can be fixed by NOMAN, as you mention, or
also by setting "MAN=" (no value) -- either instead of using MKMAN=no.
