On the point that Steve Dovich raised, Intel's Pentium processor was
recently declared "an essential facility" in an anti-trust case brought by
InterGraph. Intel had been using NDA's as business weapons, and the Judge
found that illegal under the anti-trust law, and forced them to provide the
same advanced information on IA64 (Merced) and access to chip samples to
InterGraph as was given (or to be given) to all the other Intel licensees,
despite the fact that Intel had revoked InterGraph's NDA's over a patent
dispute.

With that injunction on the books, perhaps we can get some zealous
anti-trust lawyer to take this up pro-bono.
