You should at least ensure that the pathname is anchored, though (i.e. begins
with '/'), maybe even check it with secure_path().

libutil would be the right place.

What you need to know is which ports actually know where the kernel is. If
it's worthwhile, it can be implemented, documented, and ports which don't
can get (if possible) brought up to speed. There's also netboot to at least
think about.

I'm more concerned about making savecore work on all architectures again.
I'd back the _PATH_UNIX part of the change out, ask for comment, and then
decide what to do.
